1. These general Terms and Conditions shall apply to all aspects of use of the website www.naijabet.com (the “website”), the Account, offline services, Agents and the gaming services operated by Naijabet Limited.

2. The terms and conditions listed on this page shall be referred to as “Terms’ in context while “User” and “Customer”, “You” and “Your” refer to the person accessing the Service and accepting the Company’s terms and conditions. 3. Naijabet reserves the right to verify any Customer’s statement of age and status, and to exclude Customers from its services, if there are any doubts regarding the attainment of the minimum age required or applicant’s identity. Any Customer using our services, who is identified as underage or who has registered an account with the false information about their identity or status, shall have all his winnings forfeited and his/her (betting) account (hereinafter referred to as the “Account”) shall be blocked immediately.

6. Non-Commercial, non-professional purposes: the Customer´s interest in using the service is of a personal nature, and is to be used purely for personal entertainment. Any commercial and professional interest is discarded.

7. Naijabet does not warrant the constant availability and functionality of all or any products offered. Naijabet shall not be held liable by the Customer for any damages, losses, costs, loss of profits or any other disadvantage a Customer may incur in connection with any disconnection from or the non-availability of any of the products offered by Naijabet for whatever reason.

8. Naijabet shall not be liable if the Customer is unable to place a bet due to congestion on the sms system or any other electronic communication media used for the purposes of betting.

9. Any exception to the existing Terms of Use will be communicated in written form to the Customer. Any verbal statement made by Naijabet employees or affiliates shall be immaterial in the event of any dispute.

10. The betting contract, as well as any other legal relationship between the Customer and the Company, for every circumstance not regulated by the Terms of Use, is subject to Nigerian laws.

11. The Customer agrees that the Company may use the name, town/city of residence and/or the image of the Customer for publicity or our own promotional material. The Company may contact you to provide such material and funds may be temporarily withheld until such time the requested material has been received. The Company would only seek this material in the event of a large (in excess of NGN 1 million) win on any of the Company’s products or competitions. The Company would always make every reasonable attempt of contacting the Customer before using/requesting such material (reasonable is defined as three attempted contact attempts by telephone, e-mail or text message).

II. AMENDMENTS TO THE TERMS OF USE

1. The Terms of Use can be changed at any time by Naijabet at its own discretion. All changes will become effective on their publication on our website.

2. If you consider any amendment carried out to be intolerable, you may cease using the service.

3. The continued use of the Service after the date when the Terms of Use are meant to come into effect will correspond to a complete acceptance of the revision performed, whether or not the changes have been acknowledged.

III. MANAGING AN ACCOUNT

1. Any individual who wishes to have access to services and products offered by Naijabet must open a Naijabet betting Account. By doing so and consequently placing a bet, the User warrants that he/she has reached the minimum legal age for participation and confirms that he or she retains the legal capacity to enter into an agreement with the Company. If one of these conditions is not respected the User’s account will be closed and all other necessary measures will be implemented.

2. The right to access and/or use any/all of our services (including any or all of the products offered via the Website) may be illegal in certain locations. 4. When a new account is opened the Customer is responsible for the accuracy and up-to-datedness of all the personal information and contact details provided, including name and date of birth, address, telephone number and e-mail address. Naijabet reserves the right to close the Account when the information provided is deemed to be false or inaccurate.

5. All personal data is stored in the database of the company and will not be passed on to third parties unless recurring the terms set out in the Privacy Policy Section. Naijabet reserves the right to relay suspected offender’s saved details to sporting bodies, authorities or any other third party, which deals with the investigation of offences concerning match, game, bet, system or price manipulation.

6. Every Customer may only open one account with us. Naijabet retains the right to close the betting account of any Customer who has opened multiple betting accounts under his/her name or under different names. If we have reasonable grounds to believe that multiple betting accounts (also under different names) have been opened with the intention of defrauding the Company, we retain the right to cancel any transaction related to the said fraud attempt and proceeds from such attempt shall be forfeited.

7. After opening an account the Customer must keep username, password and/or account number a secret. All transactions where your username and password and /or account number have been entered correctly will be regarded as valid whether or not they have been authorized by the registered Account holder. Any account registration will be subject to KYC processes. The Company shall not be liable for any claims in the event that the Player gives away, tells, shares or loses his/her username, password or account number.

8. The Customer is entitled to apply for the closing of his Account whenever he/she wishes by requesting it to the Customer Service in written form. The effective closure of the Account will correspond to the termination of the Terms of Use. In case the reason behind the closure of the Account is related to concerns about possible gambling addiction the Customer shall indicate it.

9. A closed Account may be reopened when requested by its owner and granted by the Company. In such circumstances, he/she will be subject to the Terms of Use that are in force at the date of the re-opening.

10. Naijabet retains the right to exclude Users from his services at its discretion. In this case we will refund the residual credit balance in the Account using the same payment method provided upon registration, or any other payment methods adopted subsequently by the customer upon their appropriate verification. If the Account has been closed due to an infringement pursuant to the Terms of Use or to a prohibited behavior leading to collusion, Fraud or whatsoever Criminal Activity, the residual credit balance may be forfeited. The same procedure will be applied to open bets that result in winnings.

12. Customer is not allowed to transfer funds from his/her Account to other Users or to receive money from other Users into his Account, or to transfer, sell and/or acquire, user accounts.

13. If a Customer does not access his Account by “logging in” using his Account name and security details for any period of six calendar months, his account shall be deemed to be “Inactive”.

IV. DEPOSITS AND WITHDRAWALS

1. The Customer has the possibility to increase the credit balance of his Account with one of the payment methods made available by Naijabet. The Customer warrants that he/she shall not use the payment methods that belong to any third party. Any deposits that are subject to the bonus promotion offer will be regulated by the bonus promotion rules and may not be available for withdrawal. The Customer can withdraw the available credit balance of the Account using the same payment method provided upon registration, or any other payment method adopted subsequently by the customer once the full and appropriate verification has been completed.

2. Withdrawals will be remitted only to the same account from which funds paid into the player’s account originated subject to the payment providers’ restrictions. No withdrawal will be authorized if it appears to be linked with transactions predominantly performed with the purpose of allowing the transfer of money from one payment method to the other.

3. User places a call to the customer care stating the details of complaint.

User writes or Emails the admin and/or Director of the Company directly

Dispute Resolution Department then handles the complaints, queries and disputes with every sense of urgency and responsibility.

3. It shall be the responsibility of the Customer to ensure that he/she is aware of these provisions.

2. The betting contract, as well as any other legal relationship between the Customer and the Company, for every circumstance not regulated by the Terms of Use, is subject to Nigerian laws.

3. If the Customer places of a bet from a location falling outside Nigeria, such bet shall be subject to all appropriate exchange control regulations and the laws of the foreign jurisdiction from which such communication originates and it shall be the responsibility of the Customer to ensure full compliance with same. Naijabet makes no warranties and shall not be liable to the Customer if it is not able to remit any monies held by it to any account held by the Customer in a foreign jurisdiction.

XIV. PALPABLE ERRORS

1. Some circumstances may arise where a bet is confirmed, or a payment is performed, by us in error. The following is a non-exhaustive list of such circumstances:

Whenever the prices/spreads/terms offered by Naijabet are significantly dissimilar from those available in the general market,

Whenever the prices/spreads/terms offered at the time the bet is placed are clearly wrong given the probability of the forecast occurring,

Whenever a bet has been erroneously accepted on a market which should have been suspended or removed,

Whenever there is an Agent manipulation leading to an erroneous payout or withdrawal success,

Where a bet containing incompatible events is accidentally accepted, because of human or technical error,

Whenever a settlement error is made while computing or crediting the amount of winnings,

Any other situation that may be referred to as an error.

In all these cases Naijabet reserves the right to cancel all the bets accepted containing such an error, reverse any error payment, or to correct the mistake made re-settling all the bets at the correct prices/spreads/terms that should have been available at the time that the bet was placed in the absence of the error.

2. The Customer has an obligation to inform Naijabet as soon as possible of any amount wrongly credited on his/her account. Naijabet may at any time set off any positive balance resulting from the erroneous operation, as well as cancel possible bets or transactions made with the erroneously credited funds. Naijabet further has the right to suspend and/or close the Account who is found to have abused the error or malfunction and have any deposits and/or winnings forfeited. Naijabet reserves the right to correct any error made in  relation to the bet and re-settle the same at the correct price or according to the individual game or sports rules or if it not practicable to correct and resettle, to declare the bet void and return the original  stake to the account. Naijabet can deduct the overpaid amount from the balance available in the Account.

By accessing any of the products and the Account, No individual (User or otherwise) will not do anything to corrupt the website, tweak or tamper with our offline services, attempt to gain unauthorized access to any account, knowingly or negligently use any features that may affect and/or alter the products’ functionality in any way and/or attempt to or remove or alter any content form website.

3. Neither we (including our employees or agents) nor our partners or suppliers are liable for any loss resulting from any error made. Bets placed in order to cover flawed bets will stand valid if not impaired by errors.

4. In the event that, due to technical problems, the printed version of a document or of a coupon differs from the web version, the latter shall prevail.

5. In the event of any dispute the Customer agrees that the records of our server shall act as the final authority in determining the outcome of any claim.

XV. TERMINATION

Naijabet shall have the right prior to accepting any bet, temporarily to suspend or permanently to terminate, the provision of betting services to a Customer without providing any reason.

6.Should a race or event be postponed, bets will stand until the race / event is decided. Ante-post betting on sporting events is defined as bets placed up to and including the day of the event *Athletics*

1.Bets for a race or an outright event are accepted all in compete or not, therefore bets involving athletes who do not compete will be lost.

*Basketball*

1.In match betting where odds are offered for the outright win betting, unless otherwise requested, bets will be settled at the appropriate odds as being for the outright win.

2.Outright Betting: Bets are settled in line with the results announced by NBA/ NCAAB and bets stand regardless of team relocation, team name change, team schedule changes, length of season or team participation in the league.

3.Division Betting: Each team in the respective Division must complete a minimum of 70 regular season games otherwise bets will be void. In the event of a tie, NBA tie-break rules will determine the Division winner.

4.Conference Betting: Each team in the respective Conference must complete a minimum of 70 regular season games otherwise bets will be void. The teams which progress to the NBA Championship will be deemed the winners of their respective Conferences.

5.Game Betting: Bets on games not played on the scheduled date will be void. A minimum 45 minutes of play (excluding first-half betting) must take place or bets will be void. Overtime (if played) counts for determining the winner of each market.

6.First Half Betting: In the event of the first half not being completed bets will be void.

7.Specials – Highest Scoring Game: Bets on games not played on the scheduled date will be void. A minimum 45 minutes of play must take place or bets will be void. Only games contained in the Daily Special count and Overtime (if played) counts. Dead Heat rules apply where applicable.

8.Specials – Highest Scoring Player / Player Match Bets: selected player must be ‘dressed to play’ and see court time, otherwise bets will be void Only named players count. Overtime (if played) counts. Dead Heat rules apply where applicable.

*Boxing*

1.In the event of a contest being postponed, bets will stand for a period of 30 days inclusive of the original scheduled contest date.

2.Should the opponent be changed in a contest, bets will be void.

3.Where round-by-round betting is offered and a boxer fails to answer the bell for a round, the other boxer shall be deemed to have won the contest in the previous round.

4.Where a contest ends in a draw, bets on both contestants will be lost.

5.Should the scheduled number of rounds be changed, “round-by-round” bets will be void.

6.Bets for Win on points are winners only when the full scheduled number of rounds have been completed.

*Football*

Football betting is subject to the Rules of NaijaBet together with the following additions:

1.Singles and upwards are accepted on all matches unless otherwise stated.

2.All bets including correct scores are for 90 minutes play (including injury time) unless otherwise stated and agreed at the time of placing the bet, therefore extra time if played does not count.

3.Bets are only accepted on matches where we offer odds. Any bet accepted in error for a match where we are not offering odds will be void with multiple bets standing for the remaining matches on which we are offering odds.

4.Where the success of one selection affects the winning chances of another selection in multiple bets, the stakes concerned will be divided equally where the selections clash e.g. trebles will become doubles, and doubles will become singles etc, however special (Scorecast) prices are available for the combined First Goalscorer and Correct Score in matches where we offer odds for both the First Goalscorer and the Correct Score.

5.Where the same team is taken to win two or more events, reduced odds will apply, in all other cases multiple bets are settled at the odds and terms on the same basis as bets at Starting Price or voided outrightly.

6.Should the venue printed on our published list be reversed or changed to a neutral ground, or the team plays a different opponent, bets will be void.

7.Bets for Divisional Championships will be settled on the league tables published at the end of the season to include any points deductions applied by the league prior to the end of the season.

8.Divisional play-off’s or points deducted after the end of the season will not count.

9.Match Specials are accepted for all Premier League and live TV matches as Singles only.

10.In the event of a multiple bet being accepted in error, stakes will be divided equally and settled as singles bets.

11.First or Last Goalscorer Betting

The First Goalscorer or Last Goalscorer will be as declared by the Press Association (PA) immediately following the match with any subsequent change by the PA disregarded.

12.Bets for First or Last Goalscorer who do not play, or bets for First Goalscorer who come on as a substitute after the first goal has been scored will be void

For First Goalscorer or Last Goalscorer betting, own goals do not count.

Odds are available for ‘No Goalscorer’ therefore in the event of no goals being scored or only an ‘own goal’ being scored; bets for First Goalscorer or Last Goalscorer are lost.

13.In the event of two or more players having an identical surname, then unless requested / identified by their forename, team, or odds at the time of the bet being placed, bets will be settled as being for the player with the shortest odds. In the event of the shortest odds applying to more than one of the players, dead-heat rules will apply.

14 First Goalscorer – Each-Way Betting

Bets for First Goalscorer are also accepted as each-way with the Place part settled at 1/3 odds a place on the 1st goal, 2nd goal and 3rd goal or the actual number of goals where less than three goals are scored, excluding ‘own goals’.

15.Where the selected First Goalscorer scores the first goal, both the Win and Place parts of each-way bets are successful, should the First Goalscorer additionally score the 2nd and or 3rd goal(s), no additional returns are payable.

Where the selected First Goalscorer does not score the first goal but scores the 2nd or 3rd goal, the place part of the bet is successful.

Should the selected First Goalscorer score both the 2nd and 3rd goals, returns are only payable on the 2nd goal.

Where the selected First Goalscorer comes on as a substitute after the first goal has been scored, both the Win and Place parts of the bet will be void, however where the selected First Goalscorer comes on as a substitute before the first goal has been scored, both the Win and Place parts of the bet will stand.

Last Goalscorer or ‘No Goalscorer’ are not accepted each-way and in the event of being accepted in error, the Win part will stand with the Place part void.

*Abandoned and Postponed Matches*

In the event of a match being abandoned, bets will be void; however bets for the First Goalscorer where a goal has been scored will stand.

A weekend match which is not played or is postponed, will be void unless the match is played on the following day or the Monday in the case of a Bank Holiday weekend.

A postponed midweek match will be void unless the match is played within the same week up to and including the Saturday.

Betting-In-Play

Betting-In-Play odds are available on selected live televised matches and are updated online at www.NaijaBet.com. It should be noted that Betting-In-Play odds fluctuate constantly and as ‘live’ TV and other broadcasts are subject to delayed transmission, advertised odds may no longer be available or may have changed at the time of placing a bet.

Live bets beyond 75 minute mark are not accepted as valid bets

Unless otherwise stated e.g. in bets to qualify, all bets are for 90 minutes play.

In the event of a match being decided by a ‘penalty shoot-out’, the score at the end of extra time will count as the match result for bets placed after normal time.

Multiple bets involving related contingencies such as ‘Total Goals’ and ‘Time of First Goal’ are not accepted and if accepted in error the stakes concerned will be divided equally .

The actual number of corners taken will decide betting on ‘Number of Corners’.

Golf

Bets placed from the Monday onwards preceding the event are settled ‘non-runner no bet’ with the stipulation that a deduction in line with Tattersalls Rule 4c (see Rule 24) may apply to winning bets. Should a player withdraw subsequent to teeing-off, bets on that player will be lost.

Bets placed prior to the Monday preceding the event are settled as ‘all in compete or not’ therefore bets on a player not taking part are lost.

The result of any play-off will determine the result of a tournament. Where players tie for places, dead-heat rules will apply.

Should a tournament be affected by adverse weather, bets will be settled in line with the published result irrespective of the number of rounds completed, however should no further play take place subsequent to a bet being placed, the bet will be void.

In Match betting, the winner will be the player with the lowest score over 72 holes, however should one of the players miss the cut after 36 holes, the other player will be deemed the winner. In the event of both players missing the cut, the winner will be the player with the lowest score over 36 holes. Match betting includes odds for a tie, therefore should a match result in a tie; bets on both players will be lost.

In Group betting e.g. ‘Top British Player’ etc., the winner will be the player with the lowest score over 72 holes. Bets are ‘non-runner no bet’ therefore in the event of a player from the group withdrawing, a deduction in line with Tattersalls Rule 4c will apply. Unless determined by a play-off, dead-heat rules where appropriate will apply.

In 2 or 3 ball betting, the winner will be the player in the pairing or group with the lowest score over 18 holes. Should a player in a 2 or 3 ball, not tee-off; all bets on the pairing or group concerned will be void.

In the event of a player in a 2 ball failing to complete the 18 holes, bets on both players will be void. Should a player in a 3 ball fail to complete the 18 holes, bets on the player concerned will be lost and bets on the remaining players stand.

In the event of a 2 or 3 ball pairing / group being re-arranged, bets will stand as per the original pairing or group.

Odds for a tie are offered in 2 ball betting, therefore in the event of a tie, bets on both players will be lost. Dead-heat rules where applicable will apply to 3 ball betting.

*Ice Hockey*

In match betting where odds are offered for the outright win OR handicap betting, unless otherwise requested, bets will be settled at the appropriate odds as being for the outright win, however if only handicap betting is available, bets will be settled in accordance with the handicap.

Bets not played on the scheduled date will be void.

Unless otherwise stated, games must have a minimum of 55 minutes play and where a game is abandoned before 55 minutes play, bets will be void.

If a game goes to overtime, the first team to score a goal will win the game and the goal will be added to the total goals market and reflected in the match/handicap result. Should no goals be scored during overtime, a shoot-out will take place and the winner of the shoot-out will be credited with a one goal victory which will be added to the total goals market and reflected in the match/handicap result. The actual shoot-out score does not count for any market.

Championship (Stanley Cup), Conference Outright and Divisional betting: Bets will still stand if a team changes name OR relocates OR is suspended from league OR for any other reason, is unable to complete the season.

*Tennis*

Outright Betting: Bets are ‘all in compete or not’ therefore bets on a player not taking part are lost.

Match Betting: Should the first Set of the match not be completed, bets on the match will be void. If a player fails to complete the match after the first set has been completed, the player progressing to the next round will be deemed the winner.

Set Betting: In the event of a match not being completed, Set betting will be void.

*Non-sporting Events*

Bets involving non-sporting events are subject to the Rules of NaijaBet together with the following additions:

Bets related to the weather will be settled in line with the official bulletins issued by the Meteorological Office and or The Weather Centre as determined by NaijaBet. Bets are accepted in singles only for the named locations on which prices are offered.

I)  if we discover or have reason to believe that you are depositing money into your Account which is in connection with a criminal activity and/or other illegal activities.

j)     if we discover or have reason to believe that you have exploited or participated in the exploitation of a fault, loophole, error, Malfunction or Interruption  in the Services and/or in our or any third party’s software.

II. AMENDMENTS TO THE TERMS OF USE

III. MANAGING AN ACCOUNT

6. Every Customer may only open one account with us. Naijabet retains the right to close the betting account of any Customer who has opened multiple betting accounts under his/her name or under different names. 7. After opening an account the Customer must keep username, password and/or account number a secret. Any account registration will be subject to KYC processes. The Company shall not be liable for any claims in the event that the Player gives away, tells, shares or loses his/her username, password or account number.

The effective closure of the Account will correspond to the termination of the Terms of Use. In this case we will refund the residual credit balance in the Account using the same payment method provided upon registration, or any other payment methods adopted subsequently by the customer upon their appropriate verification. If the Account has been closed due to an infringement pursuant to the Terms of Use or to a prohibited behavior leading to collusion, Fraud or whatsoever Criminal Activity, the residual credit balance may be forfeited. 12. Customer is not allowed to transfer funds from his/her Account to other Users or to receive money from other Users into his Account, or to transfer, sell and/or acquire, user accounts.

13. If a Customer does not access his Account by “logging in” using his Account name and security details for any period of six calendar months, his account shall be deemed to be “Inactive”.

IV. DEPOSITS AND WITHDRAWALS

1. The Customer has the possibility to increase the credit balance of his Account with one of the payment methods made available by Naijabet. The Customer warrants that he/she shall not use the payment methods that belong to any third party. Any deposits that are subject to the bonus promotion offer will be regulated by the bonus promotion rules and may not be available for withdrawal.
